If I take 12 weeks of FMLA leave, am I entitled to return to the same position at the end of my leave?

Although your employer may place someone in your position while you are taking leave, your employer may not legally terminate you while you are off on a Family and Medical Leave Act (FMLA) leave. Once you return to work, you are allowed to assume either your previous position or a comparable position, at an equal compensation and level.
